Recent Schoolbus Accident
Hi my daughter & some of her friends were injured, after a pupil ran across the road behind the school bus. This caused an oncoming car to swerve away from her & into the back of a stationary school bus. My daughter was badly shaken when she phoned me, a few teachers had arrived on the scene & were asking if everyone was ok. They then were told to get back on the bus & wait for another. She was too scared to wait on the school bus, as the next one was not expected for another 45 mins. A lot of children were crying a few had hit there head/faces on the windows, others were in shock. My daughter & her friend decided to catch a public bus home, rather than stay sat on the school bus. As they saw it approaching the bus stop they left the school bus, as did many of the other children. When my daughter arrived home she was clearly in shock, a few hours later she began complaining about pain in her legs, we were concerned as she had both hips pinned a few years back. She complained again the following morning, but she wanted to go to school as she was worried about her friends, we gave her more pain relief & urged her to phone us if it got any worse. At 11.30 we received a phone call from school explaining that my daughter was in a lot of pain & wanted to come home. We collected her from school & took her straight to A&E after various examinations a few hours later the prognos was whiplash & soft tissue damage to her collarbone & shoulder. This happened outside school on 5/04/14 I am really annoyed that my daughter was let return home from school injured & that her & her school pals were not looked after & evaluated & cared for until the parents were informed. The school are saying it's nothing to do with them as it happened off the school grounds. Sorry for the rant but I feel helpless while listening to her paining. Which has continued down her legs & up her back, we were told this is normal. It all feels wrong to us :(

They are correct, it did happen of school premises.
How ever it happened aboard the school bus, there fore my understanding is it is there duty of care by the bus company.There is however at times a difference between Scots & English law...
Accidents do sadly happen & to be honest i am shocked by the treatment of the teachers involved in this.
In Scotland, most local authorities insist all accidents are reported to them instantly ..Another school bus should of been supplied.
I cannot for the life of me understand an ambulance not being called, as no teacher is qualified in first aid, nor qualified to assess injuries inc whip lash, which in fact can mask other more serious injuries inc spinal, regardless if they are walking wounded or not, plus the fact heads hit windows..
My advice would be to check on your councils & schools safety policies, regarding teachers advice .
Then take your concerns to your Mp & local Councillors, who can fight for you.Thank you for this

Duty of care
my son has just started secondary school and goes on the bus. The bus is organised through our school (so we pay them) and it is a local transport firm they use. Who is responsible for the children wearing seat belts? The school or the bus company, my son is says that hardly any or none of the children wear belts and he gets called names if he wears it.

Duty of care,
This should be enforced by the school..Also by bus company, driver should ensure this happens

overloading( double decker)!
My 15 year old travels on a school bus contracted out to a private bus company by the local council. Over the last 3 weeks we've had issues with the bus doubling up on it's run resulting in 3 to a seat and some standing. As a parent i'm extremley concerned as to what happens to those standing if an accident should happen. I've raised the issues with the council and school the school state that its out of their control but understand our frustration. The council on the otherhand seem to take the bus drivers word that there was plenty of room on the bus and the pupils didn't sit in all seats, several of my daughters friends and parents have all had this response. I'm not allowed to have more bodies than seats in my car so why should buses be allowed to get away with it.

Any information on what i can do would be gratefully recieved

Very right to be concerned
There should be seats for every child
Firstly its not the schools remit really but a caring head teacher should raise concerns with the LA.
Do you have a PTA , raise it with them Governors, school council

Way round proof , take a photo, sure the kids would manage that

Obviously no seat belts on this bus, as it would be breaking the law
If your child is standing on a school bus, you can complain , you can ask you local authority what their safety assessment is for this procedure, [ they must have a written safety assessment for this ] as in –
How safe do they think this is, a child standing with school bags etc.- What would happen if the bus were to suddenly brake, how is your child protected-What happens to your child plus their bag which in fact become a a weapon to other passengers.
They must have one by law, even if a route changes or company changes they need a new one each time..They have to show this to you if you ask.

3 to a seat is not illegal sadly , but very few LAs use it, due simply to safety concerns, as I said ask for the review, then someone will have to make a decision regarding it.
It is frowned on though
Common sense will tell them its not safe, hopefully. Contact your local councilor, & your Mp, Mps love a postbag answer, looks good for them.
Also contact your local media, they ;ove school bus stories that endanger lives

Re adults supervising on buses for children
Is there a UK law about the gender of adults supervising in the transportation of children?

Should there be a male & female adult on a bus containing a mixed group of children aged from 4 - 12 years of age?

Ruth. Not as far as I know.
Any adult amongst or supervising children will have, or should have, a disclosure certificate, which ensures they are clear to work with children. Disclosures are a legal requirement however when working with children.

If it was a long bus run where toilet stops would be required , I would assume a safety assessment would of been completed by the organisation or local authority so there in fact would be supervisors of both sexes to assist the younger children.

Isle of Man school buses
I live on the Isle of Man where the man in charge of our bus department has put forward a ridiculous proposal. He wants to purchase 10 bendy buses which he plans to use as school buses due to the business of the current school buses and the increased passengers that can fit on a bendy bus. One problem though....100 of the 150 (approx) passengers on those school buses will be standing passengers in rush hour traffic. The public is in uproar due to the increased risk of accidents to our children. Need some advice if poss.

Really strange, see its only a proposal ,.You Need to contact all who can help, your parliament representative, school board, school transport manager, media.


Your school transport manager, would need to carry out a safety assessment firstly, unsure of laws in IoM though, could well be very different from rest of UK.


Children standing is not a good idea, in fact anyone standing is not, severe or sudden braking can cause bad injuries, on young & old alike !!! bags etc become missiles unless storage for them.
I would say a big safety issue , that is simply to save money & Ill thought through.

All you can do is fight this on all fronts, using all means.. It might also depend on distance to travel, & speed expected, I have no experience of your roads I am afraid.

I am really sorry that's the only help I can offer meantime,, as I am sure your own Manx parliament would have the biggest & last say in this. Let me know how it progresses.
